These Terms of Service ("Terms") govern your use of our adventure tourism services, including cycling tours, climbing sessions, and guided city explorations in Melbourne, Australia. By booking any of our services or participating in our activities, you agree to be bound by these Terms.
Urban Pulse Co. ("we," "our," or "us") reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after such changes constitutes acceptance of the new Terms.
2. Adventure Services
2.1 Service Description
Urban Pulse Co. provides outdoor adventure experiences including but not limited to:
- Guided cycling tours through Melbourne's urban landscape
- Rock climbing sessions and instruction
- Urban exploration adventures
- Adventure skills workshops and training
- Equipment rental and safety instruction
2.2 Booking and Cancellation
All bookings must be made through our official website or authorized booking partners. A deposit may be required to secure your booking. Cancellations made 48 hours or more before the scheduled activity will receive a full refund minus a processing fee. Cancellations made within 48 hours are subject to a 50% cancellation fee.
3. Safety Requirements and Responsibilities
3.1 Participant Requirements
Participants must:
- Be at least 16 years old (or accompanied by a parent/guardian)
- Complete and sign all required waivers before participation
- Disclose any medical conditions that may affect participation
- Follow all safety instructions provided by our guides
- Wear appropriate clothing and use provided safety equipment
3.2 Health and Fitness
Our activities require varying levels of physical fitness. Participants acknowledge that outdoor adventures carry inherent risks and that they are participating at their own risk. We reserve the right to exclude participants who we determine are not fit for the activity or who may endanger themselves or others.
4. Liability and Risk Acknowledgment
Important: Outdoor adventure activities involve inherent risks including but not limited to personal injury, property damage, or death. By participating in our services, you acknowledge these risks and agree that Urban Pulse Co., its employees, guides, and partners will not be liable for any injuries, damages, or losses that may occur during participation.
Participants are required to sign a comprehensive liability waiver before engaging in any activities. This waiver is legally binding and limits Urban Pulse Co.'s liability to the fullest extent permitted by Australian law.
5. Equipment and Property
5.1 Equipment Rental
All equipment provided by Urban Pulse Co. remains our property. Participants are responsible for the proper use and care of all equipment. Any damage or loss of equipment due to misuse or negligence will result in repair or replacement charges.
5.2 Personal Property
Urban Pulse Co. is not responsible for loss, damage, or theft of personal property during activities. We recommend leaving valuable items at home and bringing only essential items in a secure bag.
6. Weather and Environmental Conditions
Activities are subject to weather conditions and may be canceled or modified for safety reasons. In cases where Urban Pulse Co. cancels an activity due to weather or safety concerns, participants will receive a full refund or the option to reschedule.
Participants should be prepared for changing weather conditions and dress appropriately for outdoor activities in Melbourne's variable climate.
7. Photography and Media
Urban Pulse Co. reserves the right to photograph and film participants during activities for promotional and marketing purposes. By participating, you consent to the use of your image and likeness in our marketing materials, website, and social media channels unless you explicitly opt out in writing.
8. Code of Conduct
All participants are expected to:
- Treat guides, staff, and other participants with respect
- Follow all local laws and regulations
- Respect the environment and follow Leave No Trace principles
- Refrain from behavior that may endanger themselves or others
- Not participate under the influence of alcohol or drugs
Urban Pulse Co. reserves the right to remove participants who violate our code of conduct without refund.
9. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Urban Pulse Co. and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without explicit written permission.
10. Privacy and Data Protection
